Former President Trump Asks Top Court Approval for National Guard Forces in Chicago Area

On Friday, the government submitted an urgent appeal to the US supreme court, requesting clearance to send national guard personnel to the state of Illinois.

This step is part of a wider push to expand the domestic use of the troops in a number of urban centers under Democratic control.

Court Fight Over Guard Activation

In an emergency filing, the US Department of Justice asked the bench to overturn a previous judicial decision that had stopped the deployment of several hundred state guard members to the Chicago area.

The presiding judge had voiced concerns about the White House's reasoning for deploying forces, questioning its explanation in considering the situation on the ground.

A federal appeals court supported the initial ruling on Thursday, maintaining the activation on standby while the judicial dispute moves forward.

Government's Justifications

The top government lawyer, acting for the administration, stated in the new filing that federal agents have frequently been “menaced and targeted” in downtown Chicago and the neighboring town of Broadview community.

This location is home to an federal immigration detention facility.

The commander-in-chief has already dispatched state guard personnel to Chicago and Portland, Oregon, after prior sendings to Los Angeles, Memphis, Tennessee, and Washington DC.

The president has stated that troop deployment is necessary to control demonstrations and bolster border control.

Partisan Pushback

Elected Democrats have pushed back sharply the decision, arguing that the president’s claims are inflated and driven by politics.

They charge the administration of abusing his executive power to target political rivals.

The judiciary have also expressed doubt about the administration’s depiction of events.

Regional authorities claim that rallies over deportation policies have been primarily small and non-violent, contrasting with the former president's portrayal of “battlefield” circumstances.

Legal Basis

At the heart of the legal battle is the president’s use of a national law allowing the president to federalize the national guard only in cases of insurrection or when “powerless with the federal troops to enforce the statutes of the nation”.

The White House insists that the troops are necessary to safeguard government buildings and personnel from activists.

Current Actions

Previously, the White House took control of 300 personnel of the Illinois national guard and commanded more guard from Texas personnel into the state.

As city officials condemned the action, the former president intensified his language, urging the detention of the city's leader and the governor of Illinois, the two Democratic officials, alleging them of failing to safeguard immigration officers.

Illinois and the city of Chicago filed a combined lawsuit the White House to stop the sending.

On the ninth of October, the presiding federal judge, appointed by Joe Biden, delivered a temporary injunction stopping the directive.

Simultaneously in Chicago, at least a dozen people were detained outside the ICE facility in Broadview following serious disputes between state law enforcement and demonstrators.
